Terms of Service
1. Who we are
pixmythos is an independent service operated by an individual developer, not a company. These Terms of Service (the “Terms”) are a legal agreement between you and pixmythos and govern your use of pixmythos.com and the image tools we offer through it (the “Service”). By using the Service you accept these Terms. If you do not accept them, do not use the Service. Questions and notices go to support@pixmythos.com.
2. Who may use the Service
You must be at least 18 years old — the age of majority in the United States and in the European countries we serve — and able to enter into a binding contract. You must not be barred from using the Service under the laws that apply to you, including United States sanctions and export-control rules. We do not knowingly allow anyone under 18 to use the Service and will close any account we learn belongs to a minor.
3. What the Service does
The Service provides AI image tools. The tool currently available is the AI Image Combiner, which takes exactly two photos you provide, plus a text description, and produces one combined image. AI image generation is probabilistic: results vary between runs, may contain visual or other errors, and are not guaranteed to match your intent. Likeness, scale, lighting, and perspective are best-effort, not forensic. Do not rely on the Service for anything where an error could cause harm or loss.
4. Your account
Accounts are created by signing in with Google; we do not offer password-based registration. You are responsible for your Google account and for everything done through your account, and you must keep your session credentials secure. Keep one account per person, do not share or sell access, and tell us at support@pixmythos.com if you believe your account has been taken over. We may suspend or close an account that breaches these Terms.
5. Credits, plans, and usage
- Free credits: every account receives 5 free credits per day. Free credits expire at the end of that day and do not roll over.
- Subscriptions: the Pro plan grants 500 credits and the Business plan grants 2,500 credits per billing period. Subscription credits are granted at the start of each period and expire at the end of it. Unused credits do not carry over and are not paid out in cash.
- Consumption: each job consumes credits at the rate of the model it uses. The rate is shown before you run a job.
- Failed jobs: if a job fails, times out, or is canceled, the credits for that job are returned automatically. This is the “full refund on failed merges” described on our site.
- Changes: we may change credit allowances, job prices, and available models. We will not change the allowance of a period you have already paid for.
- Nature of credits: credits are a limited, non-transferable permission to use the Service. They are not property, have no cash value, and cannot be sold, transferred, or exchanged for money.
6. Subscriptions, billing, and trials
Paid subscriptions are billed in advance on a recurring monthly or annual basis and renew automatically until you cancel. A new paid subscription may begin with a 14-day free trial; if you do not cancel before the trial ends, the subscription starts and your payment method is charged. You can cancel at any time from your billing settings. Cancellation takes effect at the end of the current billing period, you keep your paid access until then, and we do not refund unused time on a pro-rata basis. Payments are processed by our payment provider, Waffo Pancake. Where Waffo acts as merchant of record it is the legal seller of your subscription, calculates and remits applicable taxes, and issues the invoice or receipt; where we sell directly, we do.
7. Refunds
Cancellation and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms. In short: cancellations take effect at period end, a charge is refundable in full within 14 days of purchase if you have not substantially used the credits, and failed jobs are refunded in credits automatically. Nothing in these Terms removes mandatory consumer rights you have in your country of residence.
8. Your images and our rights
- You own it: you keep all rights in the photos you upload and in the images the Service produces for you, and you may use your results commercially.
- Your permission: you must have every right needed to upload each image, and — for images showing other people — their permission. Do not upload images of other people without their consent, or images you have no right to use.
- Our licence: you grant us a worldwide, non-exclusive, royalty-free licence to store, transmit, reproduce, and process your uploads and outputs solely to operate the Service for you. This includes sending them to the third-party AI model providers we use (for example Replicate) for processing, and serving them back to your account. We do not use them for advertising.
- Privacy: your uploads and results are stored privately under your account and are not published by us. See our Privacy Policy.
9. Acceptable use
Do not use the Service to create, upload, or share: any sexual content involving minors, or anything that sexualises minors; non-consensual intimate imagery, or sexual content built from a real person without their consent; images of other people used to impersonate, defame, harass, or deceive, including deepfakes and fabricated evidence; material that infringes copyright, trademark, or other rights; material that is unlawful, hateful, or that promotes violence, self-harm, or terrorism; or anything that breaks the law where you are. You must also not attempt to bypass credit limits or authentication, scrape or reverse-engineer the Service, overload it, resell it or its outputs as a competing service, or use automation to create accounts or job volume beyond normal use. We may remove content, stop jobs, and close accounts that breach this section. We are not obliged to review content before it is processed.
10. Availability and changes
The Service is provided on an as-available basis. We do not promise any uptime or service level, and tools may be changed, interrupted, or discontinued. Anything labelled as coming soon, beta, or preview may change or never ship. Parts of the Service rely on third-party providers, and their outages or policy changes can affect the Service.
11. Ending your use
You may stop using the Service and delete your account at any time from your account settings. We may suspend or end your access if you breach these Terms, if the law requires it, or if we discontinue the Service. When your access ends, unused credits are forfeited. Sections 8, 9, and 12 to 16 survive termination.
12. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that results are accurate, original, or non-infringing, or that the Service will be uninterrupted or error-free. Where the law of your country does not allow a disclaimer, that disclaimer does not apply to you.
13. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or opportunity, arising out of or relating to the Service. Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD 50. We are an individual operator and the Service is priced accordingly. Nothing here limits liability that cannot be limited by law.
14. Indemnity
You agree to indemnify pixmythos against claims, damages, liabilities, and reasonable legal costs arising from your use of the Service, from the images you upload or generate, or from your breach of these Terms — in particular any claim that your content infringes someone else’s rights or falls within section 9.
15. Governing law and disputes
These Terms are governed by the laws of the United States and the State of [STATE], without regard to conflict-of-law rules. Before filing a formal claim, you and we agree to try to resolve the dispute informally by writing to support@pixmythos.com; we will try in good faith for 30 days. Subject to that, the state and federal courts located in[STATE] have exclusive jurisdiction and you and we consent to venue there — except that either party may bring an individual claim in small-claims court, and, if you are a consumer resident in the EEA, the United Kingdom, or Switzerland, nothing in these Terms removes the mandatory protections or the right to sue in the courts of your country of residence that the law of your country gives you.
16. Changes to these Terms
We may update these Terms. When we make a material change we will update the date at the top and, where the change materially affects you, tell you by email or in the Service before it takes effect. Continuing to use the Service after that date means you accept the updated Terms; if you do not accept them, stop using the Service and delete your account. These Terms, together with the Privacy Policy, Refund & Cancellation Policy, and Cookie Policy, are the whole agreement between us about the Service. If one provision turns out to be unenforceable, the rest remains in force. You may not transfer your rights under these Terms; we may transfer ours as part of a transfer of the Service.
17. Contact
Questions about these Terms, or anything else, go to support@pixmythos.com. We reply by email.
